Jose Menendez Menudo: Judge to Rule on New Evidence of Abuse

A judge will rule on Monday whether new evidence requires a change in the convictions of Erik and Lyle Menendez for shooting dead their parents in their Beverly Hills home over three decades ago, according to the publication.

The brothers were convicted for the 1989 shooting death of Jose and Kitty Menendez and received life terms in prison without the possibility of parole. 

If their defense attorneys claimed in the court that they had been sexually abused by their father, the prosecutors dismissed that and instead accused the children of murdering their parents to get money. 

They spent the following years appealing against their convictions and were never to be freed, AP highlighted.

These are the brutal facts behind a new attempt by Erik and Lyle Menendez, now 53 and 56, to escape their life terms. 

Both lawyers petitioned for a habeas corpus in May 2023 — a motion executed by the accused’s attorney urging a judge to determine whether the accused person’s confinement is lawful — to present fresh proof of sexual abuse by their father. 

‘The new evidence unearthed is squarely in favour of the defence that was offered in trial,’ the petition posted read.

The recent releases of the Netflix drama “Monsters: Their story were given renewed TV coverage in programs titled, “Lyle and Erik Menendez Story” and the documentary “The Menendez Brothers” in 2024. People in the public will get a chance to win a seat in a court to watch the brothers in person while they will appear virtually.

The prosecutors in the case urged the judge to resent the brothers last month as they have endeavored on matters of redemption and rehabilitation as well as being docile in prison.

Less than two weeks before the election, Los Angeles District Attorney George Gascón spoke at a news conference to seek new sentences of 50 years to life. This would make them become eligible for parole at once because they were less than twenty-six years old.

Citing the abuse evidence presented in the habeas petition, Superior Court Judge Michael Jesic is to rule on the resentencing application on December 11. 

One thing that the discovering party gets is immediate freedom; the judge also might consider the strength of the evidence. In case the brothers do not get justice in court they can try to get a reprieve from California’s governor.

This evidence is a letter from Erik Menendez penned in January 1988 to his uncle Andy Cano where Erik detailed the sexual abuse for his father. 

They haven’t talked about it since it was mentioned by Barbara Walters in a 2015 television special with their lawyers. The lawyers did not know of this letter and it was never submitted at their trials thus it is new evidence, they provide documents and testimo- nies that claim that Erik had been sexually molested by his father.
